In this waiver, the “Event” means any dodgeball session, match, training, tournament or other activity organised or run by PB Dodgeball, and the “Releasees” means PB Dodgeball and all other sponsors, organisers and volunteers and all other persons associated with the Event, including, without limitation, each of their respective shareholders, members, officers, employees, agents, affiliates and representatives.

1. Assumption of Risk

I understand that participating in dodgeball involves certain risks, including the risk of physical injury, damage to property and even death. I voluntarily choose to take part and accept those risks.

2. Fitness to Participate

I certify that, to the best of my knowledge, I am physically fit, have sufficiently prepared or trained to participate in dodgeball, and have not been advised not to participate by a qualified medical professional.

3. Release of Liability

I agree to waive, release and discharge the Releasees from and against any and all claims, liability, injury, loss or damages arising out of or relating to the Event or the activities associated with it, including, but not limited to, those risks which may be attributed to or associated with any negligent act, omission or fault of any of the Releasees.

4. Financial Responsibility and Indemnity

I accept financial responsibility for any injury that I may cause either to myself or to any other participant of the Event. Should the Releasees be required to incur legal fees and costs to enforce this waiver, I agree to reimburse them for such fees and costs. I further agree to indemnify and hold the Releasees harmless from liability for the injury or death of any person and damage to property that may result from my negligence or intentional act or omission while participating in the Event.

5. Code of Conduct

In signing this waiver, I also agree to abide by the PB Dodgeball Club Code of Conduct, which is available for me to read on request, and I understand that I may be subject to disciplinary procedures should I break club rules and regulations.
